1. These terms

These terms are between you and Vaile Australia Pty Ltd (ABN 58 701 414 655), and they cover your use of Vaile: this website, its tools and your Vaile account. By using Vaile’s tools or creating an account you accept them. If you do not accept them, please do not use the tools or create an account. You can still read the website.

How we handle your personal information is in our Privacy Policy.

2. Who can have an account

A Vaile account is for people aged 18 or over, and one account is for one person. Vaile is made for people who work or study in healthcare in Australia, including people moving here to work, but anyone may read the website.

3. Your account

You sign in with your Google account or with a link we email you. There is no Vaile password. Because your Google account or your email is how you get in, keep them secure, and tell us straight away at hello@vaile.com.au if you think someone else has got into your Vaile account.

Give us accurate details. What a tool tells you is only as good as what you put into it.

4. What Vaile provides

Vaile provides general information and tools that work out figures and dates from rules we have checked against published sources, such as awards, enterprise agreements, the ATO, Services Australia and the National Boards. Anyone can use the tools. A free account keeps what they work out, so you are not asked again.

Each tool works from the details you enter and the rules as they stood when we last checked them. It shows the figures it works out and, where it cannot work something out from a checked rule, says so rather than guess.

5. What Vaile is not

This section matters more than any other, so it is stated plainly.

  • Not financial advice. Vaile gives factual information and general information only. Nothing in it is a recommendation or an opinion about a financial product, and nothing takes your objectives, financial situation or needs into account. Our calculators are for working out figures, not for deciding whether to acquire, keep or change a financial product such as super, insurance or a loan. For that, consider advice from a licensed financial adviser.
  • Not a tax agent. Vaile is not a registered tax agent or BAS agent. Its tax figures are estimates from published rates, not a tax agent service, and are not to be relied on to prepare or lodge a return. A registered tax agent, or the ATO, can tell you what applies to you.
  • Not a migration agent. Vaile is not a registered migration agent and does not give immigration assistance. It does not advise on any visa application, or on which visa suits you. Only a registered migration agent or an Australian legal practitioner can give that advice; you can find one on the Register of Migration Agents.
  • Not legal advice, and not insurance, credit or lending. Vaile does not arrange insurance, is not a lender and does not tell you which credit, product or provider suits you. Where there is a choice, it is yours.

6. How far to rely on it

The rules Vaile works from change, and a tool can be wrong. Where your own contract, agreement, policy, registration or the official source says something different, follow that. Check anything important against it before you act, and tell us if you find an error so we can fix it.

A figure a tool works out is an estimate based on what you entered and the assumptions it states. It is not a quote, an offer or a decision about what you are entitled to.

7. Vaile is free

There is no charge for Vaile’s tools or a Vaile account, no subscription and no card to give us. We will not charge you for anything without telling you first and asking you to agree.

8. Introductions to professionals

If you ask us to put you in touch with a licensed professional, such as a broker or an adviser, we will tell you first whether we are paid for it, and share only what you agree to. We do not tell you which one to choose. The professional you engage is responsible for their own advice and service.

9. Using Vaile fairly

You agree not to:

  • use Vaile for anything unlawful, or to harm anyone;
  • put in anyone else’s personal information without the right to, or any patient information;
  • copy, scrape or extract Vaile’s tools, figures, rules or content by automated means, or send automated requests to its tools;
  • copy, modify, reverse engineer or build a competing service from Vaile’s software, tools or rules; or
  • interfere with Vaile’s security, or try to reach another person’s account or any part of Vaile you are not given.

10. What belongs to whom

The Vaile website, software, tools, content, rules and brand belong to us or the people who licensed them to us. We give you a personal, non-transferable right to use them for your own purposes.

The information you give us remains yours. You give us the right to use it to provide Vaile to you, as our Privacy Policy describes. If you send us feedback or a suggestion, we may use it to improve Vaile without owing you anything for it.

11. Other companies’ services

Signing in with Google uses Google’s own service, under Google’s terms. Vaile links to other organisations’ websites, such as regulators and government agencies. We are not responsible for their content or services, and a link is not an endorsement.

12. Keeping Vaile running

We aim to keep Vaile available and accurate, but we cannot promise it will always be available, uninterrupted or free of errors. We may change, add or remove tools and features. Where a change takes away something you use, we will tell you in advance where we reasonably can.

13. Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or modified. If a consumer guarantee applies to Vaile, these terms do not limit it.

Subject to that, and to the extent the law allows: we are not liable for a loss that arises from a decision you make on a figure without checking it as section 6 asks, for the acts or advice of anyone else, such as your employer, a professional or a provider, or for a loss that was not reasonably foreseeable when you used Vaile. Nothing in these terms limits our liability for our own negligence, fraud or wilful misconduct.

14. Closing your account, and suspension

You can close your account at any time by emailing hello@vaile.com.au. We will delete it, and what it keeps, as our Privacy Policy describes.

We may suspend or close an account if its holder seriously or repeatedly breaks these terms, if it puts Vaile or other people at risk, or if the law requires it. Unless the law or a security risk prevents it, we will tell you first, say why, and give you a chance to fix it or to ask for a copy of what your account holds.

If we ever stop providing Vaile, we will give you at least 30 days’ notice and the chance to ask for a copy of what your account holds before it is deleted.

15. Changes to these terms

We may update these terms, for example when we add a tool or the law changes. We will post the new version here and update the date at the top. If a change materially affects you, we will email you at least 30 days before it takes effect. If you do not accept a change, you can close your account before it takes effect, and the change will not apply to you. If you keep your account after that, the new terms apply.

16. If something goes wrong

Please tell us first at hello@vaile.com.au, and we will try to fix it with you. That does not stop you contacting a regulator, a consumer protection agency or a tribunal at any time.

17. General

If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a right straight away, we can still enforce it later. We may transfer these terms to another business only if it takes over Vaile and agrees to them and to our Privacy Policy, and we will tell you first.

18. Governing law

The laws of New South Wales apply. You and we may bring proceedings in the courts of New South Wales or of any other Australian state or territory where you live. Nothing in this clause takes away a right you have to bring a claim where you live.
